NOTICE OF WAIVER AND RELEASE OF LIABILITY (on the Website)
(Applicable to All Participants in Activities Organized by the Iranian Cultural Society of America (Shabahang))
By participating in any activity, event, program, or gathering organized, sponsored, or conducted by the Iranian Cultural Society of America (also known as “Shabahang”), you acknowledge and agree to the following terms and conditions. Participation in any such activity constitutes your acceptance of this Waiver and Release of Liability.
1. Acknowledgment and Assumption of Risk
Participation in Shabahang activities—including, but not limited to, cultural events, classes, performances, lectures, social gatherings, recreational outings, and related travel—may involve inherent risks.
These risks may include, without limitation, bodily injury, illness, permanent disability, death, property damage, or financial loss.
By participating, you acknowledge that you understand and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, associated with your participation in Shabahang activities.
2. Release and Waiver of Liability
To the fullest extent permitted by Pennsylvania law, you hereby release, waive, and discharge the Iranian Cultural Society of America (Shabahang), its officers, directors, members, employees, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, or causes of action whatsoever—whether based on negligence or otherwise—arising out of or related to your participation in any Shabahang activity.
This release applies to all forms of injury, loss, or damage (including physical injury, illness, death, property damage, and financial loss), except in cases of gross negligence or willful misconduct, which cannot be waived under Pennsylvania law.
3. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising from your participation in any Shabahang activity, including claims brought by third parties based on your actions or omissions.
4. Medical Treatment
By participating, you consent to receive any medical treatment deemed advisable in the event of injury, accident, or illness during a Shabahang activity and agree to be solely responsible for any resulting medical expenses.
5. Photo, Video, and Media Consent
By attending or participating in any Shabahang activity, you grant Shabahang the irrevocable right and permission to photograph, record, or otherwise capture your image, likeness, or voice, and to use such materials—individually or in combination with other content—for cultural, educational, archival, or promotional purposes, in any medium now known or later developed, without compensation.
If you do not wish to appear in photographs or recordings, you must notify a Shabahang representative in writing prior to or at the time of the event.
6. Governing Law and Venue
This Waiver and Release shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.
Any dispute arising under or related to this Waiver shall be brought exclusively in the state or federal courts located within Pennsylvania.
7. Severability
If any portion of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Acknowledgment of Understanding
By attending or participating in any Shabahang event or activity, you acknowledge that you have read, understood, and voluntarily accepted the terms of this Waiver and Release of Liability, and that you are giving up certain legal rights, including the right to sue for ordinary negligence.
Your participation constitutes your full and unconditional acceptance of these terms.
This waiver applies to all events and activities organized, sponsored, or conducted by the Iranian Cultural Society of America (Shabahang), effective immediately upon participation.
